Terms of Service

1. What TearCatch Is

TearCatch is an interactive quiz platform that uses artificial intelligence to generate personalized insights about your relationships, personality, and life moments. The quizzes are designed for entertainment and self-reflection - they are not psychological evaluations, medical assessments, or clinical diagnoses.

The platform is operated by MILKIES Katarzyna Lew ("we," "us," "MILKIES") and is part of the MILKIES family of keepsake jewelry brands.

2. How Access Works - The Deal

TearCatch is free to use. There is no monetary charge. In exchange for access to the platform, you agree to subscribe to the MILKIES Keepsake Jewelry newsletter.

Here is what that means in plain language:

  • What you get: Full access to all quizzes, AI-generated insights, and personalized content on TearCatch.
  • What we get: Your email address and permission to send you the MILKIES newsletter - a series of emails about keepsake jewelry, memory preservation, and our product lines.
  • If you unsubscribe from the newsletter: Your TearCatch account will be deactivated. This is because the newsletter subscription is what gives you access - it is the consideration for the service. This is the same as any subscription: if you stop paying, the service stops.
  • You can always unsubscribe. We will never make it difficult. Every newsletter email has an unsubscribe link. But unsubscribing ends your access to TearCatch.

This arrangement is recognized under EU Directive 2019/770 (Digital Content Directive), which governs contracts where personal data is provided in exchange for digital content.

3. Eligibility

You must be at least 16 years old to use TearCatch. By creating an account, you confirm that you are 16 or older.

4. Account Creation

To use TearCatch, you must create an account by providing at minimum your name and email address. You are responsible for keeping your login credentials secure. One account per person.

5. What the Quizzes Do

Our quizzes use artificial intelligence to generate creative, personalized content based on your responses. For example, you might receive a letter "written by your puppy" or discover "what your cat tells other cats about you."

Important things to understand:

  • The AI generates creative content for entertainment and self-reflection purposes.
  • Quiz results are not psychological diagnoses, medical advice, therapy, or professional counseling.
  • The psychological science informing our quizzes is used to make insights meaningful and relatable - not to assess, diagnose, or treat any condition.
  • Your quiz responses are used to recommend MILKIES product lines that may be relevant to your life story and interests. We are transparent about this: the quizzes help us understand which of our jewelry lines (Breastmilk, Wedding, Memorial, Pets, Journey, and others) might resonate with you.

6. Your Data and Privacy

We collect and process personal data as described in our Privacy Policy, which is part of these Terms. By accepting these Terms, you also acknowledge our Privacy Policy and Cookie Policy.

Your quiz responses and the profile we build from them are shared with our partner companies within the MILKIES group to provide you with relevant product recommendations and seasonal offers. The specific partners are listed in our Privacy Policy. We do not collect health data, clinical assessments, or data about your religious beliefs, sexual orientation, or political opinions.

7. Intellectual Property

All quiz content, AI-generated outputs, platform design, and MILKIES branding are owned by MILKIES Katarzyna Lew or our licensors. Your personalized quiz results are generated for your personal use - you may share them on social media or with friends, but you may not use them commercially.

You retain ownership of any personal information you provide (names, stories, photos). We do not claim ownership of your personal content.

8. Acceptable Use

You agree not to:

  • Use TearCatch for any unlawful purpose.
  • Attempt to reverse-engineer, scrape, or extract the AI models or quiz logic.
  • Create multiple accounts to circumvent the newsletter requirement.
  • Submit deliberately false information in quizzes to manipulate outputs.
  • Use the platform to harass, harm, or deceive others.

9. Limitation of Liability

TearCatch is provided "as is." To the maximum extent permitted by law:

  • We do not guarantee that quiz insights will be accurate, complete, or suitable for any particular purpose.
  • We are not liable for any emotional distress arising from quiz content. If any quiz content feels distressing, please stop using the quiz and contact us.
  • We are not liable for any decisions you make based on quiz results.
  • Our total liability to you for any claim arising from your use of TearCatch shall not exceed EUR 100.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by applicable law.

10. Termination

By you: You may close your account at any time by unsubscribing from the MILKIES newsletter or by contacting us at [email protected]. Upon termination, we will delete your personal data in accordance with our Privacy Policy.

By us: We may suspend or terminate your account if you violate these Terms, or if we discontinue the TearCatch platform. We will give you reasonable notice where possible.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of TearCatch after changes take effect constitutes acceptance. If you disagree with the changes, you may close your account.

12. Governing Law and Disputes

  • If you are in the EU/EEA: These Terms are governed by Polish law. You may bring claims in the courts of your country of residence. You also have the right to use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
  • If you are in the United States: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that you may bring individual claims in small claims court.
  • If you are elsewhere: These Terms are governed by Polish law, and disputes shall be submitted to the courts of Szczecin, Poland.
